TERMS OF USE

Version française

Last updated: October 18, 2026

Article 1 — Purpose

These Terms of Use (hereinafter the “Terms”) define the conditions for accessing and using the Report Deliverability service (hereinafter the “Service”).

Report Deliverability is an online platform that allows users to analyze the technical configuration, authentication and certain reputation indicators of emails in order to identify issues likely to affect their deliverability.

Use of the Service implies acceptance of these Terms.

Article 2 — Description of the Service

Report Deliverability offers, in particular, the following features, subject to availability:

  • Analysis of email headers and technical characteristics.
  • Verification of the SPF, DKIM and DMARC authentication mechanisms.
  • Analysis of DNS configuration and mail servers.
  • Lookup of public blocklists or blocklists accessible to the Service (DNSBL/RBL).
  • Identification of sending IP addresses and servers.
  • Detection of certain anomalies likely to affect deliverability.
  • Generation of technical reports, recommendations and quality indicators.

Features may change without this constituting a substantial modification of the contract.

Article 3 — Access to the Service

The Service is accessible over the Internet, subject to technical availability.

Some features may be offered free of charge, while others may require creating an account or subscribing to a paid plan.

The publisher reserves the right to temporarily restrict access to the Service in the event of maintenance, technical incident, abusive use or threat to the security of the platform.

Article 4 — How the analyses work

To perform a diagnosis, the user may be asked to send an email to a test address provided by Report Deliverability.

The Service may analyze:

  • The technical headers of the message.
  • The IP address of the sending server.
  • The sending domain name.
  • The authentication mechanisms.
  • The technical content and, where necessary for the test, the content of the message.
  • Reputation information available from third-party services.

Results are based on the data available at the time of the test.

Results are technical indications, not a guarantee that emails will be received.

Article 5 — Limits of the results

Deliverability depends on many external factors, including the filtering policies of mailbox providers, server reputation, recipient behavior and the configuration of sending infrastructures.

Consequently, Report Deliverability does not guarantee:

  • The actual delivery of an email.
  • Its placement in the primary inbox.
  • That it will not be classified as junk or spam.
  • The permanent accuracy of information provided by third-party services.
  • The removal of an IP address or domain from a blocklist.
  • The improvement of a score or reputation after applying the recommendations.

Any scores and indicators displayed are indicative technical assessments.

Article 6 — User responsibilities

The user undertakes to use the Service in accordance with applicable law.

In particular, the user is responsible for:

  • Holding the necessary authorizations to test the addresses, domains and infrastructures concerned.
  • Not using the Service to facilitate spam campaigns, fraud or unlawful activities.
  • Not submitting confidential or sensitive data that is not necessary for the analysis.
  • Respecting the rights of third parties and the regulations governing electronic communications.

The user remains responsible for the content of the emails submitted for analysis.

Article 7 — Personal data and confidentiality

Report Deliverability may process certain data necessary for the operation of the Service, including:

  • The user's email address.
  • Technical information about the messages submitted for verification.
  • The IP addresses and domain names analyzed.
  • The dates and times of tests.
  • Connection data and technical logs.
  • Information necessary to manage accounts and subscriptions.

This data is used to provide the Service, produce reports, ensure the security of the platform, handle support requests and comply with applicable legal obligations.

The processing of personal data is detailed in a separate Privacy Policy, in accordance with the General Data Protection Regulation (GDPR).

Article 8 — Data retention

Collected data is retained for a period proportionate to the purposes of its processing.

The retention periods applicable to test messages, reports, user accounts and technical logs are specified in the Privacy Policy.

Data may be deleted or anonymized when it is no longer necessary, subject to legal retention obligations.

Article 9 — External services and sources

Certain analyses may rely on data provided by third-party organizations or providers, including antispam blocklist operators, DNS services and reputation information providers.

Report Deliverability does not control the listing criteria of these lists, their availability or their removal procedures.

The presence of an IP address or domain on a list does not necessarily prove abusive behavior by the user.

Article 10 — Intellectual property

The elements making up the Service, including software, interfaces, texts, logos, graphic elements, structured reports and presentation methods, are protected by applicable intellectual property laws.

Any unauthorized reproduction, systematic extraction, redistribution or exploitation of the protected elements of the Service is prohibited.

The user retains their rights to the content and data they submit for analysis.

Article 11 — Paid plans

Certain features may be subject to a subscription or specific billing.

Prices, payment terms, and the conditions for renewal, termination and, where applicable, withdrawal are presented before any subscription and detailed in the Terms of Sale.

Free access to certain features does not guarantee that they will remain permanently available in that form.

Article 12 — Availability and security

The publisher implements appropriate technical and organizational measures to ensure the security and availability of the Service.

However, continuous and error-free operation cannot be guaranteed.

Interruptions may result, in particular, from maintenance work, network incidents, hosting failures or the unavailability of external services.

Article 13 — Limitation of liability

Report Deliverability provides a technical diagnostic aid.

The recommendations provided do not replace personalized expert advice and do not guarantee any commercial or technical result.

To the extent permitted by applicable law, the publisher cannot be held liable for damages resulting solely from inaccurate information provided by third-party services, misuse of the Service, or decisions made solely on the basis of indicative results.

Nothing in these Terms limits the mandatory rights of consumers or any liability that cannot legally be excluded.

Article 14 — Suspension and termination

The publisher may suspend access to the Service in the event of a breach of these Terms, fraudulent use or a proven risk to the security of the platform.

Where circumstances allow, the user will be informed of the reasons for the suspension and of the options for remedying the situation.

The terms for closing accounts and terminating paid plans are specified in the applicable contractual documents.

Article 15 — Changes to the Terms

These Terms may be amended to reflect changes in the Service, regulations or technical constraints.

Users will be informed of substantial changes within a reasonable period before they take effect, where applicable.

Article 16 — Governing law and disputes

These Terms are governed by French law, subject to any mandatory provisions applicable to users residing in other countries.

In the event of a dispute, the parties are invited to seek an amicable solution before initiating any legal proceedings.

Consumer users benefit from the remedies and mediation procedures provided for by applicable law.
